Este curso está diseñado para brindar a los abogados un conocimiento detallado y actualizado sobre los cambios recientes en la legislación del contrato de obra bajo el nuevo Código Civil de 2020.
Durante el curso, los participantes aprenderán sobre los cambios clave en la legislación y cómo estos cambios afectan a los contratos de obra en la práctica legal. Los temas específicos cubiertos en este curso incluyen:

Objetivos del curso:
- Recordar los cambios más importantes introducidos en la legislación del contrato de obra por el Código Civil de 2020.
- Entender la definición actualizada de Contrato de Obra, y las diferencias entre este y el contrato de arrendamiento.
- Comprender la importancia de la posesión de los Means and Methods por parte del contratista, y cómo esto afecta a las obligaciones de las partes.
- Identificar y distinguir los diferentes tipos de contrato por el precio, como lump sum, unit price, cost plus y otros, y comprender sus implicaciones en la gestión del contrato de obra.
- Conocer las obligaciones del comitente (dueño de la obra) y del contratista bajo el contrato de obra, y entender cómo estas obligaciones pueden cambiar según el tipo de contrato.
- Analizar los casos de ineficacia del contrato de obra y comprender las consecuencias de la extinción del contrato.
- Evaluar las diferentes opciones de resolución del contrato de obra y determinar cuál es la más adecuada para una situación determinada.
Al finalizar el curso, los participantes podrán aplicar su conocimiento para asesorar a sus clientes en la redacción, negociación y resolución de disputas relacionadas con los contratos de obra bajo el Código Civil de 2020, con un enfoque especial en la comprensión de los conceptos y las habilidades necesarias para gestionar eficazmente estos contratos en la práctica legal.
